Despite the unanimity of the justices, I disagree with the Supreme Court’s judgment that states may not enforce section 3 of the 14th A. That judgment is the bottom line. But far more dangerous is the majority opinion, which includes discussion that goes beyond this bottom line. Five justices have tried to prospectively prescribe two requirements irrelevant to the Colorado case. First, they claim that only Congress, not the judiciary or executive branch may enforce section 3. 1/ #LawFedi
The justices in the five person majority in #TrumpVAnderson show, once again, their utter disdain for the most elementary features of U.S. rule of law. They disregard text and precedent and trample separation of powers. Unsurprisingly then, their decision is primarily a piece of partisanship only masquerading as judicial work. 5/ #RuleOfLaw
The Texas Observer reports on Tx Dep't of Agriculture's new dress code: ”Employees are expected to comply with this dress code in a manner consistent with their biological gender" [sic] & will face "corrective action" if they don't.
Liberty has gained clearance to sue #SuellaBraverman in regard of her pushing through of police further powers to constrain/halt public demonstrations.
Now (even) more than ever we need Liberty to work to up hold the #ruleoflaw. If you're not already supporting them I urge you to make a regular donation... they are doing tough work on our behalf & we need them to keep at it.
THIS is how a lawyer invested in #RuleOfLaw acts. Jack Smith seeking to protect Nauta’s right to effective counsel and thus the integrity of the case against him and #Trump in the Mar-A-Lago documents prosecution. Gift access at https://wapo.st/44SGMl5#LawFedi#LegalEthics
Excellent and interesting discussion of Giuliani’s continued lying about Shaye Moss. Aaron Blake explains how it fits a broader pattern: Republicans who have pled guilty to trying to steal the 2020 Presidential election are using public statements to imply their pleas don’t mean anything. This is a particularly insidious way to corrode rule of law. Gift access: https://wapo.st/3Nq9S4N#LawFedi#RuleOfLaw
Trump and his legal team continue to act unscrupulously (for example, lobbing wholly unsubstantiated charges of prosecutorial misconduct and frivolously reupping arguments already rejected by court). Meanwhile, Trump continues to benefit from New York State courts’ commitment to rule of law. 1/ #RuleOfLaw#LawFedi
What disturbed me most about listening to the Supreme Court questions in yesterday's hearing was the repeated demands for responses to the threat that other states could kick other candidates off ballots willy-nilly. The case is before the SC BECAUSE the highest court in CO found Trump guilty of insurrection and - because of this - kicked him off the ballot
Those questions contain in their essence an implication that the rule of law no longer holds sway in the US.
however, of course, the police actions did what they wanted & both disrupted the demonstration & will act (perhaps only marginally) to chill further demos.
perhaps participants should print this out & show the police next time they are questioned at a demo!
Wow! The International Criminal Court today made public it has issued two arrest warrants against Russian presidential dictatorial war-aggressor Vladimir Putin & his "Commissioner for children's rights" in Putin's office, Maria Lvova-Belova, for war crimes involving the criminal deportation & transfer of children to Russia.
Reminder:
According to the Convention on the Prevention and Punishment of the Crime of Genocide, Article II forcible transfer of children from one group to another, committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group
constitutes the crime of genocide!
New York Times & Leonard Leo's justices' plot to crush Roe v. Wade.
"We learn that every major aspect of Dobbs was preordained once Barrett replaced Ginsburg: Five Republican-appointed justices wanted to abolish the constitutional right to abortion; they disagreed exclusively over how it would look and how best to deceive and mollify the American public; they fretted about how fast they could rewrite the law without revealing the fundamentally partisan nature of their ruling.
...
It turns out that abortion rights vanished in America because five conservatives barely tried to hide the fact that they could do that, simply because they could do that. And it turns out that they’re increasingly bad at covering their tracks."
Rightly, the #HomeOffice's cruel & vindictive shift in salary thresholds for visa-holders bringing families (partners) to join them is going to be challenged.
This shift in regulations has the effect of producing a retrospective constraint that goes completely against a key element of the #ruleoflaw; laws should not be retrospective (laws should constrain only future actions).
Moreover, in classic #Tory fashion, this is a change that hist the #North & the less wealthy!
#Republican-appointed judges raise alarm over #Trump attacks on #law
Federal DC Judge #ReggieWalton warned Trump’s attacks on #HushMoney trial judge & others could lead to #violence.
The Republican-appointed judge denounced Trump’s attacks against the judge presiding over his hush money trial in Manhattan & his daughter, calling them assaults on the #RuleOfLaw that could lead to violence & #tyranny.
So let me get this right... less than 1% of #rapes reported to the police result in a convention, but a retired social worker demonstrating outside court (reaffirming a jury's existing right to acquit according to the conscience) is now being prosecuted for contempt of court.
If this is the #ruleoflaw as it plays out for #women, then we can safely say we're in some trouble... & not just from the #climatecrisis
Well, that didn't take long.... less than a day after the US FTC moved to ban non-compete contracts, a business coalition led by US Chambers of Commerce has launched a legal challenge to the ban....
So for those who have argued that these non-compete clauses are not really enforceable, the argument that business still like them as a scare tactic seems to hold true - they want to be able to still deploy them (accepting that the legal aspects are different in the USA & UK)
Who in their right mind would now conclude any agreement with the London Govt?
Despite an agreement (from 2020) that the UK would accept returned asylum seekers, (now facilitated by legislation designating the UK a 'safe country') Ireland wants to repatriate some, only Rishi Sunak is refusing.
Quite apart from the morality & (in)humanity of the Tories migrant policies (which is bad enough), now he's also further trashing our reputation for keeping to agreements.
Three climate activists have been found guilty under the new law that seeks to repress protests that interfere with key national infrastructure.
With the jury instructed to ignore the defendants' reasoning behind their actions its perhaps unsurprising they were found guilty... all a bit ironic given the unseasonal heat in the court room.
Sentencing is to come & will show how serious an impact the law may have... but its not going to be good!
Despite Trudi Warner's case for contempt of court (for holding a placard reminding a jury of its ability to acquit on moral grounds in a climate protest case) being thrown out by the UK High Court because it was 'fanciful', the Tory Solicitor General Robert Courts has decided to appeal the decision.
