Twelve years ago, I wrote my first design patent article.

At the time, no one really cared about the topic at the time. I didn't get a fancy placement.

Now, the issue I investigated and discussed at length--the application of 35 U.S.C. § 103 to design patents--is before the Federal Circuit, in #LKQvGM.

Electric vehicle sales in the US were up 50% year over year in Q3. While Tesla is still the 800lb gorilla from a marketshare perspective it’s dipped from 62% to 50% share.

This is a contrary trend to the thesis behind its massive valuation — that Tesla will effectively be bigger than the rest of the auto industry as EVs take over.

Analysts are hoping the Cybertruck reverses the trend. The problem is it looks terrible while other car makers have sexier cars coming.

@mekkaokereke @carnage4life but somehow EV sold in the US are getting bigger and more truck like. I considered buying a new EV a few months ago, and besides Tesla, and all the mid range vehicles with over 300 miles per charge were SUVs or station wagons. Sticking with my Prius for a while longer 🤷🏻

@pbump Agh. It feels hopeless—corruptness figures almost identical for one candidate without a record and another multiply indicted ….. similarly for one candidate who is old and another who is both old and erratic and a serial fabulist.

If all the panelists are men and the moderator is a woman, do you still consider it a manel:

@design_law I think context is important. As part of a larger conference, sometimes a panel comes together with just men, and that’s okay. I’m helping organize a two panel symposium for our law review, and at one point because of invitations declined and withdrawals we had just one woman (besides me and the female student moderators) on the panels. That’s not the case now (we’re about half and half) but I the condemnation of a manel would be distorting.

@design_law Makes sense. And actually I agree, moderating is a lesser role, so if the charge of manel is appropriate it would apply regardless of the moderator.

    My son tested positive for last weekend for the first time for either of us. We had been pretty consistent about masking but I had let him slip in camp last week. He’s getting better & I’m isolating & hoping for no long COVID. In any case, folks, rates are rising.
