So am I being extra sensitive about this spam complaint email? Well yeah probably. But see at the end of a long exhausting irritating school year. @drcaberry Do you post a lot and use a lot of hashtags? You do. Do you cover a worthy topic that I don’t see covered anywhere else? Yes! That’s why I follow you. You lift a topic that many of us wouldn’t see otherwise. Is it spam? No. It’s awareness building, representation, and visibility.

A person responded to the skepticism shown by the justices by saying, "So we're just ignoring the Constituiton?"

That's the fault of pundits who led people to believe the issue is a slam dunk.

"Either we win this or the Constitution is in shreds!" might work in come contexts. Visualize Billy Flynn dazzling the jury.

Unfortunately statements like, "Either we win this or the Constitution is dead" was used to dazzle on-line and cable audiences.

@Teri_Kanefield The other issue that I think harmed Colorado’s arguments is that, as far as I can tell, they did not have any 14th amendment scholars helping shape their brief and strategy. Several submitted amicus briefs, but they should have helped shape the strategy. I still think that case would have failed because we just don’t have a robust history of section 3 legal interpretation after the first couple years of reconstruction (and, yes, I’m aware why we don’t have that history).

I don’t get it. Biden has done a fantastic job as president and seen us through some of the toughest times in recent history. The economy is strong, unemployment is at 60-year lows, inflation is tamed. But there are people calling for that youngster to drop out? (I have 6 years on him…) Why aren’t they calling on the guy who’s been indicted in four places and charged 91 times to drop out?

    @clive any case in which a presidential candidate might credibly intimidate witnesses or officers of the court and set the stage for violence perpetrated against them by his followers during a legal proceeding such that a judge has to contemplate tailoring a gag order to prevent that behavior is flat out unfit to serve as President. Why can’t journalist say that in plain and unambiguous language?

    @georgetakei and no provision in the Constitution gives the court authority for Judicial Review, if you want to REALLY be a textualist. Judicial Review was established by case law.
