Here is the appellate court's denial of Trump's claim of immunity:

The decision opens by summarizing the allegations in the indictment, being careful to add that guilt hasn't yet been determined.

The court then dismisses the idea that they don't have jurisdiction over the issue and concludes that it does.

Then, on to immunity. The court rejects Trump's "separation of powers" argument, saying this:

Ever heard of the "Toledo War?" Me neither.

"It was a boundary dispute between the U.S. states of Ohio and the then Michigan Territory, and erupted in 1835 and lasted into 1836. At the heart of the conflict was the city of Toledo, strategically positioned at the western end of Lake Erie, and both jurisdictions claimed it due to conflicting state and federal legislation and surveys."

@andrew @law Of course. We Michiganders are pretty happy with the outcome of the Toledo War. Especially so since the Mackinac Bridge opened in 1957, connecting Michigan’s upper and lower peninsulas.

    Next question: Why would anyone continue to trust The Cochran Library with the history described in this article of misleading the public?

    Why could Ansel Adams make such great, enduring photos? Four main reasons:

    • He had a great eye for subject and composition

    • He knew his subjects - the American landscape, etc - exceptionally well.

    • He was an absolute master of technique, some of which he invented and developed himself.

    • He was willing to schlep an enormous amount of delicate, heavy, expensive gear long distances to the middle of nowhere. Seriously.

    @tzimmer_history I think cost-saving also plays a role. Stenography costs almost nothing. It takes time, effort, and competent journalists to report what is actually happening.

    The New York Times desperately wants to believe that we are not sliding towards fascism, that everything will be ok without anyone needing to sacrifice or change. It makes the NYT people feel better.

    Orwell wrote about how intellectuals talk themselves into believing that things aren’t as bad as they clearly are.

    You know the drill by now. I don't like talking about Black history. Americans know Black history. I want to talk about white American history. In other words, racism, and the erasure of both positive achievements of, and injustices suffered by, non-white people. That's what people don't know.

    Try this: Ask your white US friends what the statue of liberty celebrates.

    Now ask your Black friends. Or French folk of any color.
