#Florida lawmakers have postponed a bill that would give fetuses civil rights after a similar ruling in #Alabama has halted in vitro fertilization treatment at several clinics in the state.
The “#fetal#personhood” bill had been gaining support amid Florida’s mostly Republican lawmakers.
The legislation attempts to define a fetus as an “unborn child”, allowing parents to collect financial damages in the case of wrongful death, the Tampa Bay Times reported.
But the bill has largely stalled after Democrats argued that the legislation could affect in vitro fertilization ( #IVF ) treatments, as seen in Alabama after the state’s supreme court ruled earlier this month that embryos created through IVF are considered “#extrauterine#children”.
Since the ruling, several Alabama IVF clinics have paused services.
#Republican legislators in FL hit the pause button on a bill that would have given any “#unborn child” new #protections after opponents raised concerns it would impact women’s #ReproductiveRights in ways similar to the AL IVF ruling.
Opponents called it an effort to establish “fetal #personhood” that would put #abortion providers & people who help #women obtain an abortion at risk of being sued. “Although I have worked diligently to respond to questions & concerns, I understand there is still work that needs to be done,” state Sen #ErinGrall, who sponsored the bill, said in a stmnt. The #Florida bill’s derailment comes as #Republicans grapple w/the #political fallout from the #Alabama Supreme Court ruling declaring #embryos children. There a method to Alabama's Supreme Court madness ruling that embryos are "children". They are setting up a case to appeal to the Supreme Court -- the same one that overturned Roe v. Wade -- to get a "personhood" ruling that life begins at conception applied nationwide.
A third #Alabama#IVF clinic has halted treatment as the fallout from last week’s state Supreme Court ruling that frozen #embryos are legally #children continues to disrupt IVF access across the state.
The Center for Reproductive Medicine in Mobile, 1 of just 7 IVF clinics statewide, announced Thurs that it had paused IVF procedures in light of the court ruling.
The court ruling by the all-#Republican justices held that the state’s Wrongful Death of a Minor Act applied to all unborn children, without exceptions, & called frozen #embryos “extrauterine children.” The decision has alarmed #medical professionals & #ReproductiveRights advocates, who criticized it as being grounded in #religion & not #science.
In a concurring opinion, Chief Justice Tom Parker extensively quoted #scripture as he argued the people of #Alabama have embraced the notion that “even before birth, all human beings bear the image of God, & their lives cannot be destroyed without effacing his glory.” [wtaf???]
The first-of-its-kind ruling comes as at least 11 states have broadly defined #personhood as beginning at #fertilization in their #state#laws, acc/to reproductive rights group Pregnancy Justice, & states nationwide mull additional #abortion & reproductive restrictions, elevating the issue ahead of the 2024 elections. Federally, #SCOTUS will decide this term whether to limit access to an abortion drug, the first time the high court will rule on the subject since it overturned #RoeVWade in 2022.
@molly0xfff Spot on. This is why I’ve been trying to reframe it as an issue of personhood. When those of us who aren’t trying to sell you something talk about ‘owning your own data’ we mean it in the sense that no one else should own it; in the same way you ‘own’ yourself in a free society – in that no one else owns you. Not because you want to sell yourself but because human dignity demands it.
Imagine living in a country, a world, where you felt your government genuinely cared about your wellbeing and that of all its citizens; about planetary health and wellbeing.
Somehow currently floored by the emotions this triggers.
