Honestly, the Supreme Court justices today sounded even more deranged and clueless than I even expected. They are just too worried about hypothetical future presidents to focus on the fact that we have a former president indicted for attempting to overthrow an election who is now running for reelection on an explicitly authoritarian, anti-democracy platform. 1/

A word about #ADL: As with most organizations, I don’t agree with every position they take. But when Musk accuses the most organized voice against #antisemitism in the U.S. of costing him ad revenue, he is leaning on a most #antisemitic dog whistle (that Jews control the media) and he most definitely knows it. 1/2

It isn’t just older American Jews who are afraid of the rising antisemitism in the U.S and elsewhere. Jewish students in their twenties are coming to me to tell me that they are being overtly menaced on campus because they are Jewish. They are being harassed simply on the basis of their last names. Holding all Jews responsible for the conduct of the Israeli government is definitely bigoted; taunting and threatening people on the basis of their seemingly Jewish names is absolutely racist.

Time to spell out how many U.S. states now drastically intrude on women's liberty to control their own bodies. These states have outright bans on #abortion: TN, TX, W. Va, WI, ND, SD, ID, KY, Okla., Ark. LA, Miss., MO. These states ban abortion after 6 weeks: GA, NB. After 12 weeks: Utah, Ariz., FL, NC. #women #patriarchy

U.S. #law schools should discourage students from applying for clerkships with #ClarenceThomas; faculty should refuse to recommend students for those clerkships; firms and other legal employers should refuse to hire people who have chosen to clerk for Thomas starting this year (when the large extent of his corruption became known). Despite the unanimity of the justices, I disagree with the Supreme Court’s judgment that states may not enforce section 3 of the 14th A. That judgment is the bottom line. But far more dangerous is the majority opinion, which includes discussion that goes beyond this bottom line. Five justices have tried to prospectively prescribe two requirements irrelevant to the Colorado case. First, they claim that only Congress, not the judiciary or executive branch may enforce section 3. 1/

Stay focused. We’ve known for 4 years that, short of death, Trump would be the Republicans’ nominee in 2024. The margin of his wins in Republican primaries and caucuses makes no difference, whatever the headlines and pundits say. We will have to fight using what we have, which will be - again, short of death - be Biden at the top of the Democratic ticket, and all the down ballot Democrats across the country. Every last one of them should make it clear that constitutional democracy is at stake.

I’m grateful for the bravery of Secretary of State and the Supreme Court Justices in the majority. They have stood up for rule of law in the U.S. when it is dangerously under siege. We must publicly commend their integrity. By fulfilling their constitutional and other legal duties, these officeholders present a clear, shining counterexample to the lawless dictatorship Trump intends.

I see folks saying they are confident that ultimately this Supreme Court will reject Trump’s claim that presidents have absolute immunity from criminal prosecution for official acts. I’m not. I meant it every time I have said that Trump appointed Justices Gorsuch, Kavanaugh, and Coney Barrett are almost certainly in the tank for him. Were they not, they’d be recusing themselves from all his appeals, as their participation certainly has, at the least, the appearance of impropriety. 1/

The State Bar Court of California recommends that John Eastman be disbarred. The opinion is impressive - detailed, clear, and absolutely firm that lying about law and fact to a court is disqualifying for membership in the bar. The current Supreme Court has just granted cert in Anderson v. Griswold, a case from which at least two Justices should recuse themselves. Neither Clarence Thomas nor Amy Coney Barrett can participate with propriety. Barrett is even more compromised than Thomas when it comes to Trump. 1/

I just read a Washington Post article that said Trump, if elected again, would appoint lawyers to his Justice Department who would take a “novel” approach to law. This is like saying that somebody who planned to appoint astrologers to positions in a physics research lab would be appointing people taking a “novel” approach to physics.

Before law school, Crystal Clanton lived for a year with Clarence and Ginni Thomas. Whatever else is off about Clanton (and there is evidence of more), that connection makes it unethical for C. Thomas to have hired her as a Supreme Court clerk. That is a position of public trust and just the appearance of awarding the post on the basis of a personal relationship is ethically inappropriate. The jurors in Trump’s New York business fraud case have demonstrated courage, integrity, and respect for rule of law. How disgraceful that no high ranking Republican elected official will call for Trump’s removal from the Republican ticket.
