At a conference held by the Austrian Chamber of Commerce, the panelists repeated over and over again that Europe cannot keep up with the United States in terms of generative AI and big tech companies.
That got me thinking. Why should we even want to? If we‘re lagging
behind on tech bubbles and monopolies, that‘s a plus in my book.
Instead of desperately wanting to imitate what we see across the pond, we should use our resources to find our own way.

I just remembered an episode from my childhood. When I was five or maybe six, I wanted to sign up for a „free“ raffle. When I asked my father if he‘d allow it, he remarked that they asked a lot of questions. He asked me whether I was comfortable with the fact that they would give that information to people I had no chance of knowing. And he told me that it may even be dangerous to disclose too much personal information. More than thirty years ago, but the lesson still sticks.

Have any of you first-hand experience with Pay-As-You-Want pricing in a professional training setting (either as a seller or as a buyer)? Did it work for you, and if so, why (or why not)? I‘d be very grateful for anything you‘d like to share!

Funny how some companies, once you have given them notice that you are filing a complaint against them, start replying within hours instead of weeks. 🤔

It‘s on! I just filed a complaint against the Austrian subsidiary of a German data broker.
My first claim is that they have violated my right to information by, well, not providing any when they began scraping and selling my personal data, thereby effectively depriving me of my other data subject rights.
My second claim is that they have also violated my right to data protection by processing my personal data unlawfully and intransparently.

Tomorrow: Teaching GDPR-basics to a data broker by filing another

Being kind of a freelancer myself, I gladly refrain from using generative AI for any task my business requires. That‘s because I want to value and honour the work of others as I wish my own work to be honoured and valued.

You do realise that the «data is the new oil» metaphor implies something rather unpleasant for us, the data’s source, right? If you don’t, just look up how oil became oil.

First, big tech scraped and sold our data for advertising. Now they are also scraping and selling our data for training large language models. Is anyone still doubting that there‘s huge value in our data? 🤔

A big recruiting platform just answered my demand for access to my personal data (which was presumably given to them by a data broker) by sending me a screenshot of the data broker‘s job ads with no further explanation.
Do they want me to apply?!? I don‘t think the data broker would hire me though. They already know me and I‘m quite sure they do not like me very much. 😆

News about significant data breaches appear to break on a daily basis now. Yet some (business) people still give me strange looks when I tell them that the best way to protect data is to not have it stored. 🙄 You can‘t lose what you don‘t have. It‘s that simple. 🤷‍♂️

If I had a Euro for every time a company tried to convince me that the GDPR is valid only as long as it does not interfere with their respective business model, I‘d have MANY Euros. 🤦‍♂️🙄 Of course, the exact opposite is true: Their business models are valid only as long they are not interfering with the GDPR!

I just filed a complaint against the Austrian subsidiary of a credit rating agency for allegedly violating my GDPR-access-rights. Other than a copy of the (extensive) data they have on me, they have provided almost no additional information on its processing. This makes it virtually impossible for me to exercise my data subject rights and therefore contradicts the GDPR‘s principles. Now, the data protection authority will have a say.

A well intentioned piece of advice for all the data brokers out there: If you offer the personal data you‘ve amassed to a privacy professional, they might hit you with everything the GDPR has in store. And yes, that just happened. 🤦‍♂️😆

@rysiek I will be kind of live-tickering here on Mastodon. A little teaser: I‘m currently preparing the first (of many) complaints and will file with the DPA this week.
The whole story will follow as soon as I have my website up and running. 🤓 I’m looking forward to telling all of you how a giveaway-pen started it all. 🙃

I‘m shocked by the response I got from a data broker today. And not because they didn‘t give me any information on what they are doing with my data (which they didn‘t), but because of the copy of my data, which they did give me.
The amount of data they have is - for a lack of a better description - surprising. They must have scraped every single bit of information for years and never deleted any of it. Oh, we‘re going to have fun.

@steve I can’t comment on how these cases are treated by the British DPA now the United Kingdom has decoupled from the GDPR.
But in the European Union, it seems that we are finally making some progress in the right direction. Some recent ECJ and DPA decisions have scrutinized data broker‘s practices. Now it’s important to keep the pressure up, not necessarily for the penalties as such, but to make such problematic business models as uncomfortable as possible.

ralb,
@ralb@privacyofficers.social avatar

@steve But as far as I know, the British DPA won’t recognise recent decisions of the ECJ and other institutions any longer?
