Once again, I beg the people calling for US federal or state governments to host #Fediverse servers to consider the implications of the #FirstAmendment on server moderation.
Remember how the courts have ruled that elected officials can't block people on social media? That, only many times worse.
The minute such a server existed it would be inundated with CSAM and other illegal material in replies to posts from it.
This may not be impossible to solve, but it's probably nearly so. #politics#USPol
Joshua Russell had pleaded guilty to a fed charge of making an interstate #threat against #Hobbs, a Dem who was AZ’s chief #elections officer in 2022 & is now the state’s gov.
Some jails allow book shipments from Amazon and big-box chains, while denying book shipments from independent bookstores. Now, an independent bookstore, Avid Bookshop, has filed a lawsuit alleging that this is unconstitutional.
ICYMI, #SCOTUS has heard oral arguments in 5 cases involving questions about how the First Amendment applies to social media posts – and it’s all part of a larger effort by conservatives to block what they claim is government censorship
The case involves a lawsuit initiated by… #Missouri & #Louisiana & individual #SocialMedia users. They accuse the #Biden admin of violating the #FirstAmendment by operating a sprawling federal “censorship enterprise” to #influence platforms…. Justices #Kagan & #Kavanaugh, who previously worked in Democratic & Republican admins, respectively, suggested that such exchanges were routine occurrences & did not amount to #censorship or #coercion in violation of the constitutional right to #FreeSpeech.
I'm not sure exactly where and how the #FirstAmendment ought to fit into our discussions about the fate of #TikTok, but it surely fits somewhere. Does Chinese control mean that TikTok enjoys no constitutional protections whatsoever?
It never ceases to piss me off that he's pissing away millions of our tax money on defending blatantly unconstitutional laws that do nothing but promote the culture war and divisions in this country.
#SCOTUS is “…far behind in issuing rulings for cases heard since the start of the term in Oct. The #court has announced just 5 decisions, leaving 92% of cases to be resolved b4 the term ends in late Jun or early Jul.
“…the court’s backlog represents the slowest pace of any term in the tenure of CJ #JohnRoberts. By Mar1 of the ‘05 term, the court had issued rulings in >⅓ of its cases. That dropped to 21% by this point in the ‘20 term. This yr, it is at 8%.”
“Back in the fall, it seemed the most significant cases on the court’s calendar would be a trio of challenges to the power of the administrative state & a pair of #FirstAmendment cases targeting #laws in TX & FL that control how major #socialmedia platforms curate #content. Since then, #Trump’s #legal & #political troubles have seemingly overwhelmed the docket.”
New this morning at Media Nation: A longtime investigative nonprofit may be nearing the end of the road, and why a federal judge’s civil contempt ruling threatens a free and independent press. #journalism#FirstAmendmenthttps://dankennedy.net
