Tues night, prosecutors told Judge #AileenCannon who is overseeing Trump’s #ClassifiedDocuments case that a “fundamentally flawed” order she had issued was causing #delays & asked her to quickly resolve a critical dispute about one of #Trump’s defenses — leaving them time to appeal if needed.
The cases #Trump is facing charge him w/ #FalsifyingRecords to allegedly cover up a #HushMoney payment to an adult-film actress during the 2016 presidential election; mishandling #ClassifiedDocuments & #obstruction of government efforts to retrieve them; & #ElectionInterference in the 2020 presidential election. #LocalAuthorities brought 2 of the cases against Trump w/no evidence of coordination, & a #SpecialCounsel acting independently of the WH brought the 2 federal cases against him.

So why has #justice not moved forward (aside from slow start, Garland, #GymJordan obstruction, etc.)?
Because an entire middle-of-the-pyramid chunk of criminals (in green here) went from blatant #treason / #obstruction to denying subpoenas & then heading committees to investigate!
Jeff DiSantis, a spox for the DA’s office, noted in a text message that the case had not been put on hold, adding that prosecutors will “work to move it forward to #trial as quickly as possible.” The DA’s office will only comment on the #appeal in #court filings, he said.
Trump argues that as a fmr president he has #immunity, & that the case is politically motivated, while #SpecialCounsel#JackSmith …has some choice language for those claims: “woefully short of the requirements … no evidence whatsoever … frivolous … so lacking in merit … no support in constitutional text, separation of powers principles, history, or logic.”
#JackSmith’s team is due to face off w/ #Trump’s lawyers on Thurs in Judge #AileenCannon’s #Florida courtroom over 2 of Trump’s dismissal motions. Expect, at a minimum, several days of hearings before the #trial, giving more opportunity to see how Cannon, a relatively new & inexperienced judge, is handling this high-profile matter.
Menendez's #Senate seat will be contested in the Nov 5 election, & multiple NJ #Democrats are vying to replace him. The chamber is divided 50-50 between Dems & #Republicans, w/ VP #KamalaHarris able to cast tie-breaking votes for the Dems.
Judge #AileenCannon says two #amicus briefs filed by Trump-aligned lawyers "may be of considerable help" to her on Trump's motions to dismiss (biased much??)

1 says Jack Smith appointment was invalid
#Legal analyst Allison Gill agreed, "Might be in preparation for her [#AileenCannon] ruling on unsealing the #witness list & #testimony. #JackSmith said he would appeal to the #11thCircuit if she didn’t overturn her own unsealing order."
The charges, returned by a grand jury in #Manhattan, come just 2 months before Mr. Menendez, Ms. Menendez & 2 New Jersey businessmen are scheduled for #trial.
All 4 defendants had pleaded not guilty to the earlier charges & are expected to appear for an arraignment on the new charges soon.
The #indictment comes just days after a 5th defendant, Jose Uribe, a New Jersey businessman, pleaded #guilty to 7 counts, including #obstruction of justice & #conspiracy to commit #bribery, & agreed to cooperate w/the government’s investigation.

Trump’s longtime CFO & accountant, Allen Weisselberg, has pleaded #guilty to even more #crimes—this time, Perjuring himself and frustrating the bank fraud case against his former boss.
In other words, in what universe are you telling me Allen Weisselberg did not lie because he was told to lie by Donald Trump and/or discussed with him his plan to lie to save his boss
And yet he gets a lesser sentence and doesn’t have to give up any more information. That’s pretty damn good for someone who lied, got caught, and perjured himself.
#Congress plans to use 2 packages of #legislation to fund the entire govt. The #House must vote on the first package this week, then move it to the #Senate for a vote. Legislative action must be complete before the Mar 8 funding deadline that was set late last week to avoid a partial #GovernmentShutdown.

The #DOJ advises Judge #AileenCannon that the "60-day rule" does NOT apply in #Trump's case as he has already been #indicted & the case is already being litigated.
So, no reason to delay taking him to #trial, even w/ #election in Nov.
Important note: the 60-day rule is NOT a #law it is just internal DOJ guidance. The policy is regarding making new allegations shortly before an election when a person can’t have a trial to argue them.
