The Trump appointee overseeing an “unprecedented judicial investigation” into forum-shopping allegations—levied against some of the nation’s top LGBTQ civil rights lawyers—has threatened to jail some of the lawyers involved.

A huge story out of Alabama: https://www.lawdork.com/p/alabama-burke-threatening-jail-lgbtq-lawyers

This is a HUGE story, and I intend to do much more with it, but I felt it important to at least lay out the contours of this story for the public in light of Burke's latest moves — and the lawyers' decision to go to the Eleventh Circuit briefly today: https://www.lawdork.com/p/alabama-burke-threatening-jail-lgbtq-lawyers

SCOTUS grants no new cases this morning. It also took no action on the Tennessee and Kentucky gender-affirming care cases, meaning these petitions will be relisted to be considered in another conference. https://www.supremecourt.gov/orders/courtorders/052024zor_d1o3.pdf

Justice Sam Alito sold at least some of his stock in Anheuser-Busch and bought stock in Molson Coors on Monday, August 14, 2023, amidst an anti-trans boycott.

What happened and what’s it mean? At Law Dork, I explain: https://www.lawdork.com/p/alito-bud-light-stock-sale-anti-trans-boycott

Last August, as an anti-trans boycott of Bud Light was in its fifth month, Alito sold Bud Light stock.

On Monday, SCOTUS could take up cases challenging anti-trans laws banning gender-affirming care for minors. All signs suggest Alito will participate. https://www.lawdork.com/p/alito-bud-light-stock-sale-anti-trans-boycott

Justice Sam Alito, who has considered cases over anti-trans laws this year, may have participated in an anti-trans boycott last August.

ALSO, LEST YOU WONDER: Yes, justices shouldn't own individual stocks at all — please, write those stories, use this as an example! — but that isn't the point of my story, which is that a justice voting on trans cases might have participated in an anti-trans boycott. That's its own problem.

Twenty years ago today, the first same-sex couples married legally in the United States, in Massachusetts. Some thoughts on that day — from Mary Bonauto, who argued the case that brought marriage equality to Massachusetts and later, in Obergefell, to the nation — by way of a 2013 profile I did of Mary. https://substack.com/@chrisgeidner/note/c-56642737

Here’s my report on today’s big 7-2 SCOTUS ruling rejecting the right-wing attack on the CFPB — and Kagan’s very interesting concurrence.

Thursday notes:

  • At 10a, we're expecting one or more SCOTUS merits decisions.
  • At the justices' private conference, it appears they will be considering whether to hear cases over bans on minors' gender-affirming care (in TN & KY).

I am so glad @ifilljustice mentioned the Anderson 14th Amendment case. Her amicus brief in the case is an absolute must-read — especially in light of the decision we got.

For those following along, Judge Mark Pittman's visual timeline criticizing the Fifth Circuit's actions in the CFPB credit card late fee rule challenge — discussed here: https://www.lawdork.com/p/trump-appointee-pittman-blasts-fifth-circuit — was formally entered on the Fifth Circuit's docket this morning. So, we'll see how that goes.

Two big things on Friday that I covered at Law Dork over the weekend:
• Judge Mark Pittman blocked the CFPB credit card late fee rule — but went on to aggressively push back on the actions of the Fifth Circuit (his bosses, in one sense) in the case: https://www.lawdork.com/p/trump-appointee-pittman-blasts-fifth-circuit

• Justice Clarence Thomas told the Eleventh Circuit Judicial Conference that Washington is a “hideous place,” which I point out follows 40+ years of his amassing power in Washington — and exploiting it. https://www.lawdork.com/p/justice-thomas-attacks-dc-as-hideous

The Fifth Circuit is so far off the rails that a conservative Trump appointee district court judge had to draw them a chart to explain.
