I'm 2,000 words into a story involving hundreds of pages, in dozens of documents, over multiple years.

It's an important story — worth the time and money I'm putting into it. But I can only do this b/c of you.

SCOTUS again takes no action on the Kentucky and Tennessee bans on gender-affirming medical care for minors. They will be relisted for a later conference. As noted at Law Dork last night: https://www.lawdork.com/p/enter-june-the-scotus-rush-approaches

Here’s Delligatti v. US, the case the court did grant today: https://www.supremecourt.gov/docket/docketfiles/html/public/23-825.html

SCOTUS also vacates and remands in a challenge to Arkansas’s congressional map in light of Alexander v. SC State Conference of the NAACP. (I’m not sure this changes the outcome; I think it primarily just forces the text in Alexander to be used.) Docket: https://www.supremecourt.gov/docket/docketfiles/html/public/23-138.html

We knew this is almost surely what Alito would do. This is why I wrote this last week: https://www.lawdork.com/p/sam-alito-is-a-problem

No word today on the cases challenging TN & KY's bans on gender-affirming medical care for minors, meaning they will be rescheduled for another conference.

The final decision, also by Alito, is in Brown v. US. The 6-3 decision in an Armed Career Criminal Act application case features a Jackson dissent, joined by Kagan and, in part, Gorsuch. Sotomayor joined the majority. https://www.supremecourt.gov/opinions/23pdf/22-6389_6537.pdf

With that, 34 SCOTUS decisions remain, including Trump immunity, mifepristone, administrative agency powers, internet content moderation, EMTALA and abortion care, and more.

Thursday, May 30, is the next scheduled opinion day, as noted on the SCOTUS home page calendar.
