The EU Pay Transparency Directive came into effect in June 2023, and the member states have three years to incorporate it into domestic law.

Key points:

  1. Pay ranges must always be disclosed in job ads.
  2. Companies cannot ask about previous or current pay.
  3. Companies cannot prohibit employees from disclosing their pay details.
  4. Employees can request information about their pay level, and average pay levels broken down by gender and category of workers doing the same or equal work.

  1. Companies must report average pay gaps between women and men annually. This information must be public.
  2. Companies must report to the workers' representatives on any gender pay gap in each category of workers doing the same or equal work.

The Directive is mostly good news for workers, yet it has deficiencies:

  1. Pay audits are limited to companies with 250+ employees.
  2. Companies can define what "work of equal value" means.
  3. Refers to ‘workers representatives’ instead of trade unions, which opens a door to yellow unions and "representatives" appointed by the company.

  1. The Directive does not address other categories of pay discrimination, such as discrimination based on age, disability, migrant status, being LGBTQ+, and other forms.
  2. Pay information does not guarantee the ability to self-advocate for fair compensation. If the individual bargaining powers of employees are low, the benefits of learning how much the employees are underpaid are limited.   • only 52% report that they “always” or “often” use all of their vacation time each year
  • only 48% move or exercise each day
  • only 47% take micro-breaks during the workday

Deloitte's sample size was rather small and limited to only a few countries, so let's look at some other data.

According to the European Working Conditions Survey (EWCS) 2021, the prevalence of emotional burnout ("feeling emotionally exhausted by work often or always") is 18% among workers across the EU country members - from 6% in the Netherlands to a staggering 33% in Cyprus.

What causes burnout?

Among other things:

  • job content, complex or monotonous tasks
  • time pressure and work overload
  • difficult customers
  • job insecurity
  • lack of job autonomy
  • poor working time arrangements, lack of work-life balance, overtime
  • lack of opportunities for career progression
  • discrimination, harassment, bullying
  • surveillance at the workplace
  • algorithmic management
  • constant connectivity to work

Back to Deloitte's survey for a second.

Based on the data of this survey, the C-suite experiences workplace mental health issues, too, as mentioned before.

Be wary of empty commitments, though. While over 80% of C-suite executives describe themselves as health-savvy and proclaim a commitment to improving the well-being of the employees, less than 60% of employees say their company incorporates well-being into their workplace culture.

Zero-state meditations and awareness workshops, commonly offered by companies as part of the benefit package, are all nice things, but they do not fix the underlying issue of an unsustainable, psychologically unhealthy work environment.

Well-being washing is a common symptom of a disconnect in C-suite perceptions of employee well-being compared to the employees themselves.

Prevention and long-term sustainability are crucial.

In practice, prevention means:

  1. Right to disconnect - limits on how and when workers can be contacted, a ban on communications after work hours
  2. Recognizing burnout as an occupational disease and offering extended paid sick leaves for employees diagnosed with it
  3. Flexible working where applicable, available to employees from day one
  4. Reduced workweek
  5. Extensive health coverage that includes mental health
  6. Equitable and transparent pay

Transparency is the first step to accountability.

Many of these prevention means are pioneered by the trade unions.

In July 2017, representatives of Spanish AXA negotiated a new CBA with the Confederation of Workers' Commissions (CCOO), representing the largest share of the company's employees. The CBA recognized employees' right to turn off corporate phones, not answer work-related calls, or respond to work emails or communication outside their normal working hours.

With the adoption of this policy, AXA became the first corporation in Spain to recognize this right. The Confederation of Workers' Commissions and another trade union, the Unión General de Trabajadores, have issued recommendations stressing the importance of digital disconnection and compliance with existing laws to foster work-life balance and prevent mental health issues arising from excessive remote work and constant connectivity.

Today is Labor Day for our American colleagues, and it's a perfect occasion to discuss reasons for unionization.

Some facts:
Workers' productivity has steadily grown in the past 45 years, yet their pay hasn't kept up with this increase. The workers generate more profits each year, but these profits do not return to workers proportionally to their productivity levels.

Companies, on the other hand, experience growth in profit margins each year.

For example, the profit margins of US companies have reached a record-breaking 15.5% in 2022 -- the highest level since 1950. Where do these profits end up if they don't return to workers? Shareholders, CEOs, and other top-level corporate executives.

In 2020, the ratio of CEO-to-typical-worker compensation was 351-to-1. From 1978 to 2020, the CEO pay base grew by 1322%. Typical worker's pay grew by 18.0% in the same timeframe.
