#RonDeSantis is apparently confused about the #FirstAmendment, and his authority to punish people for engaging in #protest. I can't stand these #proHamas agitators, but they have a right to protest and express their views. And the government has no authority to declare that people who protest about this issue are subject to arrest and prosecution. #DeSantis simply has no right to modify the #Constitution by fiat, and tell people they're not allowed to protest.
I had dismissed the Foreign Commerce Clause as the source of federal immigration power, but the constitution’s Importation Clause, as originally understood, indicates a disturbing connection between immigration and “commerce,” when the context of slavery is taken into account. The #DeclarationOfIndependence is not a legal document. The people who came up with it also thought the weak #ArticlesOfConfederation were great. When everything started falling apart, they pushed a #Constitution that concentrated more power in a central government. But they had to add the #BillOfRights to get buy-in from the die-hard patriotic libertarian fantasists.
