Cross-examination of #MichaelCohen resumes, an opportunity for the defense to poke holes in his testimony & perhaps trip up or provoke the state’s key witness. The questioning of Cohen, #Trump’s fmr fixer, is the beginning of the end of Trump’s #criminal trial, which began April 15 & might conclude before Memorial Day weekend at this pace.
#Merchan decides that #Blanche can do it in his own questioning. But prosecutors, Matthew #Colangelo & Joshua #Steinglass, argue that it it should come from Merchan because the questions were so misleading.
Merchan tells prosecutors that they can draft a version of an order that the judge himself would give if Blanche’s corrections end up being insufficient.
A fmr White House aide who worked closely w/ #Trump returned to the stand to testify about a significant meeting between Trump & #MichaelCohen his personal lawyer that is at the center of Trump’s #criminal trial.
#Steinglass, one of the prosecutors, says he expects to call 2 witnesses next week, & that it is entirely possible that they will rest by the end of the week.
Keep in mind that we only have a 3-day wk next wk. The trial is always off on Wednesdays, & we'll have next Friday off to allow #Trump to attend Barron’s HS graduation.
Monday will bring the appearance of #MichaelCohen, Trump’s fmr fixer & lawyer, & a crucial #witness.
#Blanche, one of Trump’s lawyers, is now asking the judge about #MichaelCohen, Blanche says he has continued to attack #Trump on the social media platform TikTok. Blanche asks the judge to order prosecutors to instruct Cohen to stop talking until the trial is over.
#Steinglass, a prosecutor, says they have repeatedly asked witnesses, including Cohen, to remain silent but have little control over them.
Justice #Merchan asks prosecutors to tell #MichaelCohen that he is personally asking him to refrain from making any more statements about the case or #Trump. “That comes from the bench,” Merchan says.
Trump flashes a wide grin as the prosecutor #Steinglass says he can’t control Cohen’s statements outside court. Then he shakes his head as court adjourns.
Trump looks delighted as he stands up at the end of the proceedings.
The prosecution asks that the defense be precluded from asking #StormyDaniels whether she was arrested. Justice #Merchan agrees w/the prosecutors, saying that “anybody can be arrested” & that it “doesn’t prove anything.”
The people call Stormy Daniels back to the stand
#Trump atty #Necheles begins questioning by saying that in 2011, Daniels denied having had sex w/Trump.
Steinglass also criticized Blanche's colleague Susan #Necheles's cross-examination of #StormyDaniels, calling it "very thorough but somewhat misleading" & hardcore [#SlutShaming ]
Prosecutor #Steinglass says that the details of Daniels's story before & during the sexual act corroborate her account, & show the fact that sex happened, which increases the motivation to silence her.
#Steinglass said that the details elicited about the sex act were important because they corroborated other parts of #StormyDaniels's story. For instance, at their non-dinner before having sex, acc/to Daniels, Trump asked her about safe-sex practices in the porn industry. Prosecutors later asked Daniels whether Trump used a condom. Steinglass argues that fewer than 10 questions actually elicited salacious details.
#Steinglass concludes: "The defense has not alleged anything remotely approaching grounds for a #mistrial & their motion should be denied."
Justice #Merchan begins to address the mistrial motion. He says that after ruling against the defense's request for a mistrial on Tues, he went back & reviewed many of his past decisions, studying them in his chambers. He says that he came away satisfied.

#StormyDaniels's lawyer, #KeithDavidson, to return to stand. He negotiated the hush-money payment at the center of the case, & is expected to lay out details of the deal.
Prosecutor #Steinglass: Did you send a denial to Stormy to sign?
Davidson: "I don't recall."
Prosecution presents a Jan 2018 statement from #StormyDaniels, in which she denied reports of a relationship w/ Trump, a denial she would later rescind. Later, she would say that while she did not have an affair w/ #Trump, she did have sex w/him.
#Steinglass asked why Cohen was pushing for her to appear on the program. Davidson answered that Cohen believed Daniels would further deny the sexual encounter w/ #Trump.
Cohen had a relationship w/ Sean Hannity, a Trump supporter. In 2018 before Cohen’s guilty plea, it was revealed that Hannity was a #legal client of Cohen’s.
The statement said that she was denying an affair w/ #Trump. Asked how truthful that was, Davidson testified that it's technically true because no one had alleged a #relationship between the 2 of them. He said a relationship is an ongoing interaction.
[#situationship?]
In Feb 2018, the #StormyDaniels story was getting attention in the news.
Davidson testified that Cohen asked him to provide a statement stating that Cohen was the source of the funds.
#Steinglass asks why he drafted it despite knowing that #Trump was or would be the ultimate source of the funds.
Davidson says that at the time of the transaction, Cohen had put up the money.
#Steinglass finished questioning #KeithDavidson in an abrupt conclusion. Before he finished, Steinglass asked Davidson if he had any stake in the outcome of the trial. Davidson said that he did not.
#Steinglass, the prosecutor, uses defense atty #Bove’s repetition of the phrase “standard operating procedure” against him, as he points out all the parts of the agreement w/ #KarenMcDougal that were not standard. Pecker agrees w/ Steinglass throughout as he asks him these questions, hurting the defense's argument.
Redirect gives Pecker the opportunity to clarify testimony muddled under cross-examination.
“All that base loved reading positive stories about Donald Trump. And when he announced his presidency, going from The Apprentice to running for the president of the United States, our sales increased. Newsstand sales increased,”Pecker says.
Steinglass sums it up as follows, “Running stories about Mr. Trump appealed to your readership.”
#Steinglass read back to Pecker portions of his testimony from yesterday that #Bove, the #Trump lawyer, questioned earlier.
The testimony relates to Pecker saying Trump thanked him for the #CatchAndKill of stories about #KarenMcDougal & the doorman’s story an illegitimate child.
Some key characters are being introduced now, including #StormyDaniels, aka #StephanieClifford, whom Pecker identifies as a porn star. #Steinglass asks Pecker: “How do you know of her?” Then he laughs & says he’ll ask the question in a different way. He takes a slightly safer approach, & Pecker begins to describe how his employees came to be in contact w/ #Daniels.
#Steinglass has seemed at ease during this direct examination of #Pecker. He is the most recent addition to this prosecution team but he is a veteran prosecutor at the Manhattan DA's office. He previously led the effort to convict the #TrumpOrganization in 2022 & also secured a conviction against 2 #ProudBoys#extremists for a violent brawl in 2019.
