FBI Director admits that the agency often can't meet the standard for probable cause when they back-door search American's communications under #Section702. In other words, the 4th Amendment to the #Constitution shouldn't apply to the FBI. https://www.techdirt.com/2023/11/21/fbi-director-admits-agency-rarely-has-probable-cause-when-it-performs-backdoor-searches-of-nsa-collections/

We’ll keep saying it until our communications are safe from snooping: if Congress is going to renew #Section702 it needs to make these necessary reforms. https://www.eff.org/deeplinks/2023/11/government-surveillance-reform-act-would-rein-some-worst-abuses-section-702

#IC proponents allied with the #Biden WH are casting doubt on whether #Section702 certifications last a full year, even if the statute expires. I flatly reported yesterday that they do. Here's what the law says, and what legislative attorneys w/ the Congressional Review Service said in March:

It's actually really hard to spy on the entire world and do it within the rule of law in a way that never allows any misuse. It's a hard and expensive thing to do, and they're not doing it very well," EFF’s Cindy Cohn told the Defense One Radio podcast

Internal Documents Show How Little the FBI Did to Correct Misuse of Section 702 Databases
FBI has released internal documents used to guide agency personnel on how to search the massive databases of information collected under FISA, including communications collected without a warrant under Section 702. Despite reassurances from the intelligence community about its “culture of compliance,” these documents depict almost no substantial consideration of privacy or civil liberties
