A few thoughts about today's oral arguments in the DC Trump- Gag order case.

But first, a word about appellate arguments in general.

You don't listen to the arguments to find out what the parties will argue. You already know that from the briefing.

You listen to to see what the court asks as a clue to what the court is thinking.

Similarly, when you argue on appeal, you can tell from the questions what the court is thinking and it's your last chance to change their minds.
