Incorporating HIPAA, NIST 800-53, or agency policy documents into a software development contract by reference means that the vendor will have to, at times, ignore the product owner, ignore user research, ignore the roadmap, and simply do what they believe those policy documents say to do. For a lot of agencies, the most appealing bit of Agile is usually this: instead of writing a bunch of requirements up front, you can write them as you go, in the form of user stories. They think that's great.

But they still want to use their stock contract that says absurd things like “you must comply with NIST 800-53" (which is actually levels of absurd) or “all work must comply with the the state IT guidelines.”

OK, but now you've lost that granular, user-story-level control.

The correct solution here is for the agency to decompose those policy documents and turn them into acceptance criteria on the relevant user stories. This means that your vendor doesn't have to become an expert in your agency's policy documents, you're paying them to do the thing that they do best—build software—and you continue to enjoy the benefits of per-user-story, per-sprint control of what the vendor is doing.

It’s box turtle mating season here in the eastern U.S.! It is good and right to help them cross the road, with a few caveats: always move them in the direction they’re traveling, always wash your hands after touching a turtle, and never try to help if you cannot do so safely.

I just went to the Virginia DMV to renew my driver’s license and my vehicle registration. That could not have been an easier or more efficient process. I think every interaction I have ever had with the local DMV office has been easy, friendly, and successful.

@mathowie More elected officials (and I mean, like, governors and U.S. senators) need to understand the extent to which public opinion abut the effectiveness of government is shaped by the parts of government that they interact with. If the DMV experience is bad, then people reasonably conclude that the 99.99% of government that they don't see must also be bad.

To improve faith in government, start by making DMVs a really great experience.

It looks to me like the SCOTUS majority is not merely disinterested in being perceived as legitimate, but actively enjoys being able to exercise power that appears illegitimate to do things that a majority of the country opposes.

@Panurge @toolbear They almost certainly were not—that was a lie Ferra told to avoid losing a lawsuit. They were first sold 30 years after Cleveland’s daughter was born, but at the peak of Babe Ruth’s popularity. This would be like selling a candy bar today and naming it after Chelsea Clinton. It’s absurd.

But Ferra stuck to their story, because they knew it was the only thing keeping them from having to pay Babe Ruth for their use of his name!
