Appeals panel grills both sides on Trump’s D.C. gag order
Both the #DOJ & an atty representing #Trump faced intense questioning Mon morning from a three-judge panel in the US Court of Appeals for the #DC Circuit. The topic was whether a limited #GagOrder imposed on #Trump by US District Court Judge Tanya S. #Chutkan unfairly limits his speech. Here’s the WaPo recap of the hearing, which lasted nearly 2½ hrs.
The narrow gag order issued last week bars Trump from making statements targeting prosecutors & court personnel as well as inflammatory statements about likely #witnesses.
#Trump appealed the order, & asked the restrictions be put on hold, pending appeal. Judge #Chutkan did so temporarily for both sides to brief the court on whether a longer pause is merited.
In a filing overnight, Smith said the court should reject Trump's request for a longer hold, & urged the restrictions be put back in place.
The #SpecialCounsel said that in the few days since Chutkan temporarily lifted the restrictions, Trump "returned to the very sort of targeting" the #GagOrder prohibits.

The article is paywalled unfortunately but I saw this elsewhere and I can't for the life of me see why Trump is not being tried while under arrest if he keeps tramping all over his release criteria 👏 every 👏 single 👏 day.

#Trump has made casting himself as the #victim of unfair prosecutions a centerpiece of his campaign message. He had been #fundraising off the potential of a #GagOrder even before it was issued. “Today really isn’t about gagging me,” he wrote in one email to supporters on Monday. “It’s an attempt to gag the American people.”
“I cannot imagine any other #criminal case in which a defendant is permitted to call the prosecutor ‘deranged’ or ‘a thug,’ & I will not permit it here simply because the defendant is running a political campaign.
“His presidential candidacy does not give him carte blanche to vilify & implicitly encourage #violence against #PublicServants who are simply doing their job.
This GOP Rep wouldn't condemn #Trump's call for #GenMilley to be executed.
Then CNN's Abby Phillips let him prattle on, give a mealymouthed response & both sides the #AtochasticTerrorism. This is pathetic & part of the reason why the #DeathThreats & #WitnessIntimidation continue.
Bottom Line: Republicans are encouraging threats of violence. When the media doesn't press them on this support of political violence, they are complicit.
Politicians know how to avoid answering hard questions. Busting through their methods isn't as easy as people think. Yes, #MedhiHassan is skilled at doing it, but the Republicans won't go on his show.
The Republicans are prepared for what they call "Gotcha Questions" from the MSM, & know the Fox Propaganda hosts won't press them on Trump's use of threats.
So we need folks like Lauren Windsor, of UnderCurrent, to record them at their events explaining why they don't condemn #ThreatsOf Violence.
#Prosecutors on Fri night called a judge’s attn to a social media post from #Trump …in which… he appeared to declare that he’s “coming after” those he sees as responsible for the series of formidable #legal challenges he is facing.
In a court filing just before 10PM Fri, #SpecialCounsel#JackSmith’s team alerted Judge Tanya S. #Chutkan about the post in which #Trump “specifically or by implication” threatened those involved in his DC #criminal case.
The prosecutors said Trump’s post raised concerns that he might improperly share #evidence in the case on social media & they urged that he be #ordered to keep any evidence prosecutors turn over to his defense team from #public view.
