lol. The last #Trump#Georgia#criminal#RICO defense argument was that charges should be dismissed because the term #FakeElectors was a legal conclusion & disparaging.
DA prosecutor got up for his turn & started by saying, “the words ‘fake electors’ do not exist anywhere in the indictment.”
The #Georgia DA prosecutor went on to argue that case #law & GA statutory law supported the use of characterizations in indictments.
Another great line from the DA atty Will Wooten was that all indictments include #legal conclusions, that’s what indictments are.
If indictments aren’t allowed to have legal conclusions, then I guess we can’t have indictments anymore.
Oh great. Last night I got random little rectangles coming and going on my browser screens (seems to have stopped today); the boot-up screen lost it's wall paper and no more prompt for 'learn more about this photo'; and McAfee doesn't launch as it usually does on boot-up (but the VPN apparently launches though I can't open it) -- it won't respond at all when clicking on the #McAfee button. I have bad feeling about this...
It will be up to the appeals court to decide whether to hear the matter. #McAfee said he would continue working to get the case ready for #trial by addressing other matters in the meantime.
But while #FaniWillis had made clear her determination to turn the page from wks of embarrassing headlines, the judge’s decision to green-light the appeal allows defense attys to keep at the forefront allegations of impropriety that threaten to damage the public’s perception of the prosecution.
#McAfee last wk said #FaniWillis can remain on the most sprawling of 4 #criminal cases against #Trump as long as Wade resigns, which Wade did on Fri.
…Attys for Trump & the other defendants said in court papers on Mon that Wade’s resignation was not enough to correct the appearance of impropriety the judge found. Defense attys say a failure to remove Willis could imperil any convictions & force a retrial if an appeals court later finds it was warranted.
“As written, these 6 counts contain all the essential elements of the #crimes but fail to allege sufficient detail regarding the nature of their commission, i.e., the underlying #felony solicited,” #McAfee wrote.
But, the judge, added, “This does not mean the entire indictment is dismissed.”
Replying to @bluestein
Wise Smith indicates he will be waiting the outcome of Judge McAfee’s decision on disqualifying Fani Willis from the Trump case before deciding how vigorously to pursue his challenge against her.
Manny Arora is an atty who reps defendant-turned-witness #KennethChesebro.
McAfee seemed unlikely to allow new evidence last wk, it’s gone on long enough & the defense (who are acting like prosecution) ought to have submitted all relevant evidence at the start or at least the initial stages.
#FultonCounty defendant David Shafer w/a new witness, CobbCounty co-chief dpy DA Cindi Lee Yeager, whom he says had convos w/ #TerrenceBradley between 8/23-1/24. Says she can corroborate that DA #FaniWillis & #NathanWade were in a relationship earlier than acknowledged.
#Scam alert. Apparently a fake notice claiming to be from #McAfee. Clues: Return address is some personal gmail address with numbers. It's cc'd to about 80 other people, whose addresses I can see. Everyone has the same order code. And I'm SPECIAL! Hah! I strongly suspect the Customer support number isn't legit and probably has someone there ready to take your personal information and credit card number to 'confirm' things.
Hello from Fulton Judge #McAfee's courtroom, where former Black Voices for Trump head #HarrisonFloyd is pushing to uphold subpoenas he sent to 3 state & local agencies 🧵 1/… #legal#TrumpIndictment#Georgia
Floyd's legal strategy is unique…plans to present evidence that Trump actually won Ga in 2020 – or that there was enough evidence on Jan 4, 2021, when Floyd spoke w Fulton poll worker Ruby Freeman, that his beliefs were not unreasonable, hence no mal intent
Floyd's team has subpoenaed mountains of evidence from the Secretary of State's office, Fulton clerk and board of elections. They say they will prove that tens of thousands of votes should have been excluded from Fulton's vote tally due to “pervasive and systematic failures"
The agencies want to quash the subpoenas. In court filings they've called Floyd's requests “vague," “unreasonable" and, per the Secretary of State's office, a "fishing expedition."
@GottaLaff If you think about it, this is pretty hysterical. Here’s my alternate headline: “Local backbencher aims to prove what hundreds of highly funded big firm lawyers and investigators could not”. Rotsa Ruck, fella.
#Trump should be treated like the baby he is. Judge #Chutkan or Judge #McAfee should call #tfg into court, explain to him that he needs to shut up to protect the judicial process and the parties involved and ask him if he understands. Then ask him to repeat back why he needs to shut up. Make him repeat until he gets it right. At least in GA this would be televised.
As I was about to research to make a new today in history post, I found out #Intel purchased #McAfee.
McAfee?! 13 years ago?! 2010?!
I only know of McAfee as three things: A antivirus program that first came with my laptop when I brought it (still glad I do fresh OS installs), John McAfee doing tax evasion and a cute anime girl
@SinclairSpeccy In 2011 or 2012 I asked a McAfee account manager why Intel bought them. He said they intended to move some of the security features into the CPU. I don't think much of what he described ended up happening. But the antivirus product was indeed what Intel bought McAfee to get.
