@RickiTarr it is true, although this photo is completely unrelated. MSNBC has the full body cam footage which is upsetting to watch. They abuse the shit out of a kid. A child who doesn’t understand why he’s being tased.

18+ Kuukisu,

@bluecaller @RickiTarr it's absolutely terrible and just fully racist.

mydogwrotethis,

@RickiTarr What's unusual about it is most of the time it would never make the news and Mendez would be forced to quietly go off to Jail for life.

@RickiTarr
Corruption at it's finest. Seems to me the charges are excessive by design in order to force a plea. No way this young man spends a day in jail. The search is not going to hold up.

@RickiTarr I see they have a petition but they need to go above Florida authority

@RickiTarr i mean you can be charged for murder if a cop kills someone while they're trying to arrest you so this almost seems like a logical next step

RickiTarr,
@RickiTarr@beige.party avatar

@waitworry That is fucking insane

@fulanigirl@blacktwitter.io avatar

@RickiTarr Yes it's real. The legal theory would be felony murder. You commit a felony with no intention of hurting anyone, but someone dies, it doesn't even have to be by your hand. The state can then charge murder or sometimes manslaughter if what you did was a misdemeanor. Prosecutors like felony murder because they don't have to prove the defendant intended to murder, they only have to prove they intended to do the underlying felony. Edit for clarity: felony murder & misdemeanor manslaughter

RickiTarr,
@RickiTarr@beige.party avatar

@fulanigirl So every medical professionals could be in prison?

CStamp,
@CStamp@mastodon.social avatar

@RickiTarr @fulanigirl If that is the case, the only response to a cop approaching you is to run and hope you get away. He had a pre-exisiting condition, he shouldn't have been at work. This is beyond absurd. And any cop who doesn't consider that a person can't understand them because of a language barrier or hearing issue also is being incompetent and endangering the public.

fulanigirl,
@fulanigirl@blacktwitter.io avatar

@CStamp @RickiTarr It might be absurd but it is the law in most states. If you run and a "good samartian" bystander tries to shoot you and hits the cop you also could be charged with felony murder in that context.

CStamp,
@CStamp@mastodon.social avatar

@fulanigirl @RickiTarr So a cop trips on a sidewalk and it's the fault of those around him?

fulanigirl,
@fulanigirl@blacktwitter.io avatar

@CStamp @RickiTarr You have to read the whole context. If a person is already engaged in a felony and the cop is interacting...that is what creates the possibility of liability.

fulanigirl,
@fulanigirl@blacktwitter.io avatar

@RickiTarr The medical people aren't generally committing felonies, but you know....sometimes they are. If you want a medical example, it would be closer to what happened to the EMT people who were involved in the death of Elijah McClain.

rpardee,
@rpardee@hachyderm.io avatar

@fulanigirl @RickiTarr (you said 'misdemeanor' there where I think (hope) you meant 'felony')

fulanigirl,
@fulanigirl@blacktwitter.io avatar

@rpardee @RickiTarr Felony murder is based on felony. Felony manslaughter is based on a misdemeanor. That what it should say.

@RickiTarr Dial back 50 years and they could still easily do this without being found out.

The only thing new here is that they get found out.

It's a little depressing.

@RickiTarr If he is released he should at least leave St.Augustine if not the US. The local cops will be gunning for him.

edit to replace Ft Lauderdale w/St Augustine.

@nilsskirnir @RickiTarr St.Augustine is about 300 miles north of Fort Lauderdale, but I get it.

    @thepoliticalcat It does, that it's a law, I guess, the rest, not really

    DrLex,

    @RickiTarr
    Well....this is what cops carry the cameras for. Let's wait and see the footage before jumping to conclusions.

    theothersimo,
    @theothersimo@mastodon.social avatar

    @DrLex @RickiTarr “St. John County Sheriff Robert Hardwick held a press conference in which he said that Aguilar Méndez was stopped because he was trespassing and that he had pulled a knife on Kunovich. After the press conference, body camera footage was released showing that a small pocket knife was found in his pants pocket after he was handcuffed was never pulled on Kunovich. Aguilar Méndez said the knife was “para sandía,” or “for watermelon,” alluding to his job.”

    @rayres @DrLex @RickiTarr Quicker and much more accurate.

    DrLex,

    @elverkonge @rayres @RickiTarr
    Cop was allowed to pat him down for weapons and was met with a nervous resistance which makes this a legal arrest for obstruction. Him dying because of it was his fault. He must have been completely out of shape.

    rayres,

    @DrLex @elverkonge @RickiTarr Cop massively escalated an entirely innocent situation leading to a young man being assaulted and tasered, spending months in jail,. potentially his whole life, and the cop's own death. Cop is entirely at fault for the whole thing.

    Oh, ETA, and of course his department then lied about it. They can't help themselves.

    DrLex,

    @rayres @elverkonge @RickiTarr The guy acted suspicious and then fought back when cop wanted to pat him for weapons. This is standard and justified.

    rayres,

    @DrLex @elverkonge @RickiTarr The poor kid was minding his own business, a bully in a uniform decided to come swing his dick, ended up killing himself and destroying a boy's life.

    Land of the free, my arse.

    DrLex,

    @rayres @elverkonge @RickiTarr
    ,It's not land of the free. I know that the cop is not the victim, we still lack sufficient information to make the other guy a victim. I'm not convinced. It's nice that you assume that people are good but that's not reality.

    RickiTarr,
    @RickiTarr@beige.party avatar
