Corruption at it's finest. Seems to me the charges are excessive by design in order to force a plea. No way this young man spends a day in jail. The search is not going to hold up.

@RickiTarr Yes it's real. The legal theory would be felony murder. You commit a felony with no intention of hurting anyone, but someone dies, it doesn't even have to be by your hand. The state can then charge murder or sometimes manslaughter if what you did was a misdemeanor. Prosecutors like felony murder because they don't have to prove the defendant intended to murder, they only have to prove they intended to do the underlying felony. @RickiTarr@fulanigirl If that is the case, the only response to a cop approaching you is to run and hope you get away. He had a pre-exisiting condition, he shouldn't have been at work. This is beyond absurd. And any cop who doesn't consider that a person can't understand them because of a language barrier or hearing issue also is being incompetent and endangering the public.
@CStamp@RickiTarr It might be absurd but it is the law in most states. If you run and a "good samartian" bystander tries to shoot you and hits the cop you also could be charged with felony murder in that context.
@CStamp@RickiTarr You have to read the whole context. If a person is already engaged in a felony and the cop is interacting...that is what creates the possibility of liability.
@RickiTarr The medical people aren't generally committing felonies, but you know....sometimes they are. If you want a medical example, it would be closer to what happened to the EMT people who were involved in the death of Elijah McClain.

Cop was allowed to pat him down for weapons and was met with a nervous resistance which makes this a legal arrest for obstruction. Him dying because of it was his fault. He must have been completely out of shape.
@DrLex@elverkonge@RickiTarr Cop massively escalated an entirely innocent situation leading to a young man being assaulted and tasered, spending months in jail,. potentially his whole life, and the cop's own death. Cop is entirely at fault for the whole thing.
Oh, ETA, and of course his department then lied about it. They can't help themselves.
