Any State that expels, returns or extradites a person to another State where there are substantial grounds for believing that they would be in danger of being subjected to torture, is violating international law (UN Convention Against Torture).
Also, keep in mind that when xenophobia-promoting/enforcing politicians claim "voluntary returns", that usually is not voluntary as normal people understand it but through economic pressure of removing subsistence conditions or direct threat that if the persons do not "voluntary return" they will be forcibly deported under worse conditions.

If a person has made it clear to officials that they are or intend to seek asylum, deporting or otherwise forcibly returning them is a violation of international law (UDHR, Refugee Convention, &c).
