Via Secrets and Laws:

What's most troubling about #Cannon entertaining #Trump's Presidential Records Act argument is that's she's SEEN all the records now, during the Sec. 4 hearing. She knows they are all highly classified intel products. And yet she's still entertaining this "personal" record BS.

@GottaLaff Regardless of what happens with the court cases dragging on and on, and all this game playing, and possibly worse, we have to act as if everything is on us. WE the people have to protect we the people. Make sure everyone you know or bump into is informed and ready to vote.

@GottaLaff Cannon's approach is bizarre, but at this point, it's not clear that what she's doing is benefiting Trump's case.

Her pattern has been to give Trump's lawyers every opportunity to perfect their case before the trial. This fits in that pattern.

I think the PRA argument is nonsense. I think Cannon thinks it's nonsense. But she's giving Trump's lawyers an avenue before the trial to show that it's not.

Basically, she is saying, if I accept your argument, how can the trial progress?

GottaLaff,
@GottaLaff@mastodon.social avatar

@tob I totally disagree. She's been slow walking everything.

tob,
@tob@hachyderm.io avatar

@GottaLaff Unquestionably true. But in the sense it helps Trump, it's only because it gives his lawyers ample opportunity to revise their arguments.

Trump's problem is that he doesn't need better arguments. He needs a jury to find him innocent even though he is guilty.

Until and unless Cannon does something to prevent the case from going to trial, all she's doing is drawing things out.

GottaLaff,
@GottaLaff@mastodon.social avatar

@tob I know that. And by drawing things out, she could possibly (and willfully) aid and abet his effort to prevent it from every taking place.

tob,
@tob@hachyderm.io avatar

@GottaLaff Cannon's dragging things out, but that's what normally would happen for anyone else with Trump's resources.

For example, Trump's lawyers ask for extra time because he's also on trial in New York. Seems ridiculous, right?

But it's not.

It happens commonly that a person is indicted in two jurisdictions at the same time.

Usually, what would happen is the trials would run in sequence. Because it is his right to be present for his trial.

GottaLaff,
@GottaLaff@mastodon.social avatar

@tob We couldn't be farther apart.

Thanks for the chat.

@GottaLaff Cannon isn't shutting down the prosecutor's efforts to get the trial underway before the election, but she's also not forcing Trump's lawyers into a compressed schedule.

The frustrating thing is that Cannon seems to acknowledge Trump's complaint about the effect of the trial on his campaign, but she doesn't acknowledge the danger to justice if Trump is elected President before the trial ends.

GottaLaff,
@GottaLaff@mastodon.social avatar

@tob Oh yes she is. There's no doubt about that.

Thanks for the chat though.

@GottaLaff Anything to appease her “Master”. I cannot fathom how an inexperienced judge who has NEVER tried a criminal case is allowed to preside over this. If I had told my boss that I want to hire this fresh college grad as a Senior Architect who can figure how best to design an architecture for a complex set of applications that have multiple inputs/outputs/APIs, etc. , he would have looked at me as if I were crazy!
Aren’t there rules regarding the kind of cases rookie judges can handle?

GottaLaff,
@GottaLaff@mastodon.social avatar

@Shantis She came up in the rotation, luck of the draw.

There's nothing illegal or wrong with that. Just reallllly bad luck for us and the rule of law.

Shantis,
@Shantis@mstdn.social avatar

@GottaLaff I understood that - but there still needs to be cases matched to judges based on complexity of the case and the experience of the judge

GottaLaff,
@GottaLaff@mastodon.social avatar

@Shantis One would think. But it doesn't seem to work that way.

Are the Crossfire Hurricane records in Mar-A-Lardo? I heard those were missing. Time to open a case in Bedminster. I'm shocked they haven't already. I remember seeing boxes of documents loaded into a plane for Bedminster a year ago? It was on the news. Why wasn't it searched then?

I know!! I truly believe there are docs in there. Her death right after her NDA expired is extremely suspicious. She "fell" down the stairs? No one will investigate because her family doesn't care. These people are truly evil.

@GottaLaff Harry Litman @harrylitman on Talking Feds says #Cannon entered that crazy ruling for Presidential Records to be introduced for a reason. She will now have that ability during the trial to dismiss all charges with prejudice. I don't pretend to understand the legal rules. But sadly, this trial is done. tRump walks away.
So damn maddening as this was arguably the strongest case between the 4 trials 😡

GottaLaff,
@GottaLaff@mastodon.social avatar

@krakalak I saw him say all that. And no, the trial is not "done." Smith can go to the 11th Circuit.

noondlyt,
@noondlyt@mastodon.social avatar

@GottaLaff @krakalak I imagine that he has to go to the 11th circuit now. There appears to be no other option. Someone is telling her exactly how to proceed with this case.
