Our REPLY BRIEF in the case of Public Resource, iFixit, and MAKE v. FCC has been posted. https://law.resource.org/pub/us/cfr/regulations.gov.docket.16/ The case is now all papered over, we're waiting on an oral argument date.

My audit of the CFR looking for incorporations by reference is bearing fruit. About to start in on Title 40 (EPA! They IBR like there's no tomorrow!). Title 17 (FDA) was like a trek through the desert, really tough.

End result is going to be a listing ~5,000 standards and which specific sections of the CFR cite those. It will also include the language of the incorporation.

This is not an academic exercise. This is my shopping list for the "Unabridged Code of Federal Regulations."

I am anticipating a hung jury in the TFG wrongful business records case (the one usually mis-called the "hush money" case).

The case has chain of reasoning ... A leads to B leads to C. And dependencies (e.g. the felony charges depend on the jury finding thing X and Y).

I've had enough experience with juries to know that they are often extremely stupid, and, as Lyndon Johnson once said,, "wouldn't know how to pour piss out of a boot if the instructions were printed on the heel."

(I was on a jury -about a gang beating of a man - that hung because although massive amounts of multiple, uncontested, eye witness evidence pointed to guilt, one juror held out because the defendants were "good boys".)

Expecting a bumper crop of pomegranates this year, my first real crop. The tree has lived here for 3 years, last year I got two fruits. I think it’s time has come. The tree is over 6 feet tall now, when it moved in here, it was but a wee sapling, under a foot tall.

The pomegranate tree started as a wee lad, maybe a foot tall, very scrawny. Now the tree is over 6 feet tall, 6 feet around. It has dozens of flowers. It is right near my front gate, so it will be a wonderful privacy tree as well as a fruit barer.

The olive tree is also doing wonderfully. It is up to 12 feet tall now. Last year was a disappointing crop: not much fruit, most of it rotten. Year before though, it was amazing and I made several dozen jars of tapenade. Hoping for the same this year.

The tree is more than 12 feet tall now. When I got it, it was a 5-foot scrawny fellow, but it was already 10 years old. It will grow huge. It is next to the two orange trees. It will be my privacy wall.

Getting hands-on experience in government programs. I've been accepted for medicare part a and b and am now applying for medicare supplement plan. If this devious plan works, my spend on health insurance will go from $1800/month for a pretty awful small business plan to $180/month, but lots of traps. Oh to be in any other country. US does not do this well.

One of things I noticed over the last couple of years (perhaps it is because of covid and the pandemic) is that when you sit down with folks and try to explain why a problem is hard, people around you start yelling "ai! ai! ai!". So you, explain it some more and they keep yelling "ai! ai! ai!' Maybe I'm just getting old.

Managed to wipe out a dozen hours of work. Reached a good stopping point, decided to clean up a dozen extraneous windows, zapped the wrong one by mistake, it had not been properly saved and when it asked was I really sure I wanted to blow it up, I blithely asserted that I did. I should of course know better by now.

My task, ICYMI, is read the entire Code of Federal Regulations, find all mentions of incorporation by reference, properly format the standard number and title (w/any provisos and qualifications), then record the precise location in the CFR (w/url) that contains the standard. Then, see which ones I have (and record the URL where it lives), then figure out where to buy what I don't have, post the audit/inventory online.

Short title for the project: "The Unabridged Code of Federal Regulations."

ANSI, joined by a large gaggle of SDOs ("Standards Development Organizations") have filed an amicus brief in the case of Public Resource, MAKE, and iFixit v. the FCC. https://law.resource.org/pub/us/cfr/regulations.gov.docket.16/index.html tl;dr: They don't really like us very much.

    I’ve been in this lounge for a few hours, am about to leave. Seen a few hundred people belly up to the bar. It is an open bar for business class. Bartenders are whirling dervishes, working really hard. People asking stupid questions like “do you only have India wines” and “may I taste it please?” Not a single person tipping. No wonder the bartenders remember me. What’s the matter with people? One of the iron clad laws of nature is “always tip your bartender.”

    I used to be a credentialed member of the press corps. If you’re covering an event of significance, you expect an open bar as a matter of course if they expect good coverage. But, even if the drinks were free, no respectable journalist would ever forget to tip the bartender.
