@joycebell @erikalyn This is an amazingly bad take on Counterman. Counterman did way more than enough to get his sorry self convicted in any state that has a mental state element of even recklessness included in their stalking statutes. Fortunately for him, Colorado's criminal statute only required proof of the victim's mental state. This take is amazingly bad because Colorado can fix the statute by just including a mental state element of recklessness. That is NBD.
