In order to be sued under a contract you have to be a party to the contract. So if some Old Master gets reproduced, once a copy is given to someone who wasn't a party to the contract they can do as they like. The only way round this would be to lock all recipients behind some kind of contract pay wall, which isn't going to be feasible for web sites, news, or even just book publishers.
