Activists rally to save Internet Archive as a lawsuit from publishers threaten to shut it down https://decrypt.co/31906/activists-rally-save-internet-archive-lawsuit-threatens

If people are smart, it's time to archive the Archive right now. In other words, fork it and turn it unto a decentralized platform. I hope someone out there is working on that.

Plus you have to think libraries need some decentralization as well as this lawsuit could kill libraries as we know them.

@joeo10@mastodon.sdf.org avatar

Here's some updates on the publishers' lawsuit vs. the Internet Archive which could very well mean the end of the not only the archive but libraries in general.

First, here's a good detailed primer of what the IA is facing just like what I shared above. https://www.thenation.com/article/society/publishers-are-taking-the-internet-to-court/

joeo10,
@joeo10@mastodon.sdf.org avatar

Then back in June, both the Internet Archive and publishers have requested a pre-motion conference on a motion for summary judgment, hoping to settle the matter without needing a full trial. https://torrentfreak.com/publishers-internet-archive-both-seek-piracy-lawsuit-win-without-full-trial-220614/

So basically it means that a federal judge will rule on the suit instead of a jury, which can take place at the end of this year or early next. https://www.dailydot.com/debug/internet-archive-lawsuit/

joeo10,
@joeo10@mastodon.sdf.org avatar

We'll see what happens there but the point is the same: the Copyright Cartel and publishers want to kill libraries as we know it and this is the first major step into that goal.

It's time to archive the Archive turn it unto a decentralized platform before it's too late. I hope someone out there is working on that plus libraries need to do this too.

joeo10,
@joeo10@mastodon.sdf.org avatar

I'll leave this with a simple fact: If #libraries were invented today or in recent times, the Copyright Cartel and publishers would both ensure that they would not be allowed to exist.

Huge Update: Big #Publishing and the #Copyright Cartel's lawsuit against the @internetarchive will have oral arguments on March 20. https://www.publishersweekly.com/pw/by-topic/industry-news/publisher-news/article/91587-oral-argument-set-in-internet-archive-copyright-case.html

Like I said, this will determine the future of not only the #InternetArchive where a bad ruling effectively kills a vital service but the existence of #libraries as we know it today.

Here's @team with their statement: https://www.fightforthefuture.org/news/2023-02-23-statement-major-decision-on-libraries-digital-rights-a-step-closer-on-march-20

joeo10,
@joeo10@mastodon.sdf.org avatar

With oral arguments of this monumental case set to begin on Monday (yes THIS Monday), here's Maria Bustillos (@maria) with a post today on what's at stake as Big Publishing and the Copyright Cartel looks to effectively kill the @internetarchive and perhaps libraries with a victory. https://www.thenation.com/article/culture/internet-archive-publishers-lawsuit-chatbot/

Long story short, not only this affects the future of the #InternetArchive and #libraries altogether but also (as mentioned) fact checking and truthful information as well.

joeo10,
@joeo10@mastodon.sdf.org avatar

A group of #librarians say that the @internetarchive is a library which that the four major publishers' lawsuit against them threatens the development of both print and digital collections. https://www.insidehighered.com/views/2023/03/17/librarians-should-stand-internet-archive-opinion

Today is the day oral arguments officially start in the Big Publishing/Copyright Cartel's lawsuit against the @internetarchive which would effectively kill the great service and perhaps #libraries altogether if it goes their way.

Here's a couple of posts on how we got here: https://www.theverge.com/2023/3/20/23641457/internet-archive-hachette-lawsuit-court-copyright-fair-use

https://www.battleforlibraries.com/

And here's the oral argument schedule and how to be involved since this will affect all of us one way or another... http://blog.archive.org/2023/03/17/heres-how-to-participate-in-mondays-oral-arguments/

Here's a couple of articles to read post hearing and now we'll wait it out.

Ars' Ashley Belanger with a post titled: "Book publishers with surging profits struggle to prove #InternetArchive hurt sales" https://arstechnica.com/tech-policy/2023/03/book-publishers-with-surging-profits-struggle-to-prove-internet-archive-hurt-sales/

And Mike Masnick (@mmasnick) with this fitting title: "Book Publishers Won’t Stop Until #Libraries Are Dead" https://www.techdirt.com/2023/03/22/book-publishers-wont-stop-until-libraries-are-dead/

No matter what happens, I'm sure this will be appealed and it's likely that SCOTUS will have to be involved in the not too distant future.

joeo10,
@joeo10@mastodon.sdf.org avatar

Very gutted to hear this decision on a Friday Night Dump no less. I already said this will be appealed no matter what happens but it's not looking good for the future of the @internetarchive and most likely #libraries as we know them and I hope the Second Circuit understands what's at stake. https://www.docdroid.net/qM0MbI7/ia-sjm-order-pdf

@mmasnick has more on this: https://mastodon.social/@mmasnick/110081107772033421

joeo10,
@joeo10@mastodon.sdf.org avatar

As we all expect, the @internetarchive will appeal and the fight for the future of the #internetarchive and #libraries as we know it will continue. https://blog.archive.org/2023/03/25/the-fight-continues/

@brewsterkahle with the statement which is here.

EDIT: Posted the corrected link.

joeo10,
@joeo10@mastodon.sdf.org avatar

Here's @mmasnick with this very good post-ruling analysis. https://www.techdirt.com/2023/03/27/publishers-get-one-step-closer-to-killing-libraries/

Basically Publishers and the Copyright Cartel are basically one win away from not only killing the @internetarchive but also #libraries as we know them. I and many others hope that the Second Circuit gets it right to keep this alive.

joeo10,
@joeo10@mastodon.sdf.org avatar

The @internetarchive has submitted a letter to the district court hoping that there will be minor changes pending appeal. https://mastodon.archive.org/@internetarchive/110872318293638005

Remember: the best way to support them is by donating which is in this link: https://archive.org/donate

EDIT: added donation link.

joeo10,
@joeo10@mastodon.sdf.org avatar

The record labels have now joined publishers and the copyright cartel in the fight to outright kill the #internetarchive (@internetarchive) as they have filed a lawsuit of their own at the very same SDNY federal court. https://torrentfreak.com/record-labels-hit-internet-archive-with-new-400m-copyright-lawsuit-230812/

joeo10,
@joeo10@mastodon.sdf.org avatar

Here's a very good report on the publishers, record labels, and copyright cartel's goal to not only kill the #internetarchive (@internetarchive) but probably #libraries altogether. https://www.nytimes.com/2023/08/13/business/media/internet-archive-emergency-lending-library.html

Archival links: https://web.archive.org/web/20230814183308/https://www.nytimes.com/2023/08/13/business/media/internet-archive-emergency-lending-library.html
https://archive.li/bguar

FACT: if libraries were created today, they would be extinct. Pay very close attention to this case as this would be a very huge blow to the profession of preservation and archiving plus a win for privatization and control.

joeo10,
@joeo10@mastodon.sdf.org avatar

Also, here's a very good post on how you can help the #internetarchive (@internetarchive) survive and we must let them exist. https://sfba.social/@morgandawn/110885357263374893

Again, the best way to help them exist is by donating, which is in this link: https://archive.org/donate

joeo10,
@joeo10@mastodon.sdf.org avatar

Yep, @Lance_Ulanoff is right here: we need more people to pay attention to these cases and find ways to #archive the #internetarchive (@internetarchive) before it's too late. https://www.techradar.com/computing/websites-apps/someone-needs-to-save-the-internet-archives-from-the-lawyers-and-i-have-an-idea

Vice and Decrypt echoed that sentiment three years ago and that's hasn't changed. https://mastodon.sdf.org/@joeo10/104332840359528864

@textfiles and @brewsterkahle I hope you're both taking this into serious consideration for all of our sakes.

More on the lower court's disgraceful decision: "Broadly, this injunction will result in a significant loss of access to valuable knowledge for the public. It means that people who are not part of an elite institution or who do not live near a well-funded public library will lose access to books they cannot read otherwise. It is a sad day for the Internet Archive, our patrons, and for all libraries." - @internetarchive

A update:

Today, the @internetarchive has officially submitted their appeal, formally setting up for the Second Circuit to take it up. https://blog.archive.org/2023/09/11/internet-archive-files-appeal-in-publishers-lawsuit-against-libraries/
