Note: based on a private criticism of my post, I wish to clarify that on the (partial) evidence I’ve seen so far, I do share the view of the independent UN Special Procedures that there is a current risk of genocide: https://www.ohchr.org/en/press-releases/2023/11/gaza-un-experts-call-international-community-prevent-genocide-against. There is a clear duty to prevent genocide. The legal scholar whose article was suppressed by the HLR goes farther, saying that genocide is unfolding. As to whether a case for ongoing genocide can be made out, that is up to a tribunal like the ICJ or ICC.
