Tue’s oral argument is focused on whether to overrule the #FDA & reimpose restrictions on getting #abortion medication. <2 yrs after #SCOTUS overturned #RoeVWade, the issue of #ReproductiveRights is returning to the high court on Tues as the justices consider whether to limit access to a med used in >60% of US abortions.
The #Biden admin & the manufacturer of #mifepristone are seeking to reverse a lower-court ruling.
@Nonilex I’ve said it before and I’ll say it again — SCOTUS has no business even hearing this case. FDA is an executive branch agency with experts responsible for evaluating clinical evidence. SCOTUS is a court responsible for evaluating law. This case was decided based on falsified clinical evidence that is well-debunked, not on a legal argument. SCOTUS has no business doing anything but overturning the lower court, which they should have done without hearing the case.
The #pharmaceutical industry warned that 2nd-guessing the #FDA will broadly disrupt the nation’s #drug-approval process & stymie private investment in #research.
The case could make it harder to get #MedicationAbortions even in states where #abortion is legal. Allowing #medication abortions to proceed w/o an in-person medical visit has increased #access, particularly for women in #rural areas & others who struggle to go to a clinic in person, allowing them to complete the process from home. #law
#SCOTUS could also further impede #abortion#access for those living in one of the >15 states w/a strict #AbortionBan in place. A few telemedicine clinics have started allowing US-based doctors to prescribe & mail pills into restricted states, relying on new “#ShieldLaws” passed in several blue states to protect them from prosecution. The largest of these clinics, Aid Access, now mails ~6k doses of #MedicationAbortion into antiabortion states every month, acc/to founder Rebecca Gomperts.
