My website? www.rentbuster.nl? From what the guy who made the website said, if I didnt put the cookie banner in, the AP would come down on me hard for breaching EU law about not having a notice about my cookies.
ughhh… this shit is beyond me. The guy who made the website said there were no cookies of consequence on the website. I couldnt care less who visits my site and I dont check the logs on this shit.
For me it only gives a full-screen “by using this websites you agree to cookies” dialog, with only an OK button.
This is not how it should usually go in the GDPR.
Note that the GDPR does not ban all cookies without consent. Some may be absolutely required for the functioning of the website, and are thus allowed without consent. An example would be cookies to save language preferences. Technically speaking, the GDPR doesn’t even mention cookies. It just says consent has to be asked when the website is processing PII that isn’t strictly necessary for the functionality.
That said, once you do process PII that isn’t strictly necessary, you must ask for consent, and you must also provide an option to decline.
The form as such with only an Ok button doesn’t allow me to figure out whether these are necessary cookies, and if they aren’t it doesn’t allow me to decline.
There’s a couple of things about that you should know. First one is that it’s possible to not have a cookiebanner if you just have anonymous statistics. You need a cookie banner only if you plan on tracking people’s IP adresses, or more.
Second thing is that it’s illegal to have a “cookie wall” as they call it. Your content has to be able to be viewed without having to consent to tracking cookies. Otherwise it would be akin to a hostage situation where you basically have to use cookies.
If any users here in Noord-Holland ever deal with harrasment, threats/intimidation, violence or such: feel free to send a message and I’ll see what I can do for you.
Hello Sorry for the late reply. I dont check this out so much. I dont think there is any basis for moving the daughter into the apartment. Has she sent you notice to leave?
No, but she has mentioned far too often about moving into our apartment. And I’ve seen the architect with her looking over plans. I’m just hoping there isn’t grounds in the renovation to evict us
Ideally, to be able to see the correct data for a listing, and an idea of what the correct rental price should be, allowing users to browse each platform and see if a listing is good or not without needing to cross-reference a bunch of sites and a calculator
I’d love to add a db to store the listing prices over time too, but that would certainly require a paid feature in order to cover the cost of storage and network traffic to the db
Glad to hear I am in luck and thank you for sharing the legislative guidance. Please refer to below responses to the queries above: a) Exactly 800 Euros, b) No such list was prepared. Only a list of items was provided in the contract but these did not make reference to the condition. c) No such inspection was performed. d) Nope, no such list to refer back to. e) No such report was communicated to me, or received in any form. f) All repairs were made by the landlord, g) Nope, no such list existed. h) No such report was signed off, i) G/W/E was included in the rent and paid for by the landlord. j) N/A refer to i, k) Will you please prepare an e-mail and I agree with your point. Dutch would be best. Fortunately I can read it ;)
I understand that this will be posted and really appreciate your effort and support to a random stranger.
I also fully comprehend the risks and understand this is a discussion and note this is not legal advise in any form.
Thanks for the follow-up. I have read about those all inclusive contracts - which is quite odd as the maximal “kale huur” is about half my actual monthly rent.
L) I have read through the contract, is not truly all inclusive, it states “de huurprijs 700, het voorschot op de vergoeding voor de overige zaken en diensten gelevered worden in verband met de bewoning van het gehuurde: 100”. So very similar to your example.
M) 29 January 2022.
N) Room with shared facilities.
O) Predetermined period, ending 18/7/2023.
P) Slightly less than 18 months in total (29-01-2022 till 18-07-2023). No options included for extension.
Thanks for the feedback on overpaying. I actually see the landlord is advertising the property at 925 p.m. now (would have shared a link, but I’m not sure if this is allowed on this community). I do indeed have photos of the property so I will certainly consider the possibility of creating a case with the rent tribunal. Also it may be easy to involve the new tenant given that he/she may be interested in a reduced rent.
Don’t apologize for all the questions, you are really a lifesaver and also these questions really help me think and learn how to approach my landlord at my current place.
Q) No I have not received such a document.
Interesting that this is a requirement, and a separate procedure exists for this.
R) Will you kindly incorporate the rent tribunal procedure - I understand the risks and also consider (based on your questions) that additional follow-through may be justified else she will continue this without a fear in the world going forward.
Don’t apologize for all the questions, your support have exceeded all expectations.
I don’t see why we shouldn’t label ALL rental contracts as consumer contracts, since, regardless of whom I’m renting from, I’m still getting the same product…
But I guess that would have other implications here.
In South Africa, where I’m from, all rental contracts are covered by the rental housing act and consumer protection act. Regretfully, South Africa is lacking in the ability to enforce said laws, but they are there none the less, regardless of being private or otherwise.
